A court in Fraga orders a financial institution to hand over a complete loan agreement so that an affected party can defend themselves.

court

The Court of First Instance of Fraga reverses a previous decision and demands full transparency in an enforcement process, requiring the provision of a notarial deed that until now was incomplete.

The Court of First Instance and Preliminary Investigation No. 1 of Fraga has issued a decree that represents a significant step forward in protecting citizens from the opacity of financial institutions. The ruling, dated February 8, 2026, upholds the appeal filed by the Huesca-based law firm Heras-Sasot Abogados against a previous judicial decision that restricted access to key information in the case.

The right to know the full contract

The legal process, which is being handled as an enforcement of court orders , was blocked following a decision issued on December 30, 2025. The affected party's defense argued that this ruling put him at a disadvantage because he did not have complete documentation of the loan being claimed against him.

The Court Clerk has upheld the arguments presented by attorney Guillermo Sasot in the appeal . Consequently, the court has ordered that an official letter be sent to the Madrid Notary Public requesting the complete deed dated December 15, 2021 (protocol number 3.565). This document is essential for understanding the contractual relationship between Ferratum Bank PLC and Adana Albatros SL.

Transparency versus banking opacity

These types of decisions are crucial to ensure that citizens are not left unprotected against financial institutions. Often, in debt claims, only fragments of contracts or partial documents are presented, preventing the affected party from verifying whether the conditions are legal or if there are unfair clauses.

With this new decree, the Fraga court guarantees that:

  • The procedure is incorporated into the full writing so that the affected party can know all its terms and defend themselves adequately.
  • Make it transparent original contractual relationship which gave rise to the claimed debt.
  • A is obtained fundamental documentary evidence which had not initially been required of the financial institution.

Next steps

The ruling has already been served on the parties involved . Although an appeal can legally be filed within five days of notification, the requirement for complete documentation marks a milestone in ensuring that legal proceedings in Fraga are conducted with full transparency for residents.
