The events were detected by the Transport Team of the Traffic Detachment of the Civil Guard of Fraga
Agents from the Traffic Investigation and Analysis Group (GIAT) of the Traffic Subsector of the Civil Guard of Huesca, have investigated the manager of a transport company in Portugal, for an alleged crime of document falsification, for the fraudulent manipulation of the tachograph of an articulated vehicle.
On September 9th, the Transport Team of the Fraga Traffic Detachment of the Civil Guard set up a checkpoint at kilometer marker 422.500 of the N-2 highway to verify driving and rest times for vehicles used for road transport. During the inspection of a truck, officers discovered that the authorized tires for the tractor unit had been replaced with larger ones than those used during the tachograph calibration. This altered the speed and distance readings received by the in-vehicle tachograph unit. Therefore, the officers proceeded to have the tachograph recalibrated at an authorized workshop using the tires with which the vehicle had been detected while in operation.
The Traffic Research and Analysis Group (GIAT) of the Huesca Traffic Subsector, in the investigation of the facts, verified that there was a positive deviation of 7.7%, both of the speed and the distance traveled by the truck, when the maximum allowed deviation is +/- 4%.
Following the efforts made by the GIAT, to ascertain the facts and locate the perpetrator, on September 10, the manager of a transport company in Portugal was investigated for an alleged crime of document falsification by the fraudulent manipulation of the truck's tachograph, being a 64-year-old man, with Portuguese nationality and residence.
The GIAT Investigation Group of the Huesca Traffic Subsector, prepared the proceedings, which were sent to the Court of First Instance and Instruction No. 1 of Fraga (Huesca), the investigated party must appear before the competent Authority, when required.
Likewise, a complaint file was prepared for an administrative infringement of the Land Transport Regulation Law for an infringement classified as very serious, whose sanction is €4001.
